Mobile Messaging Terms

These Mobile Messaging Terms (“Mobile Terms”) apply to the SMS and MMS text messaging program offered by Punch 4 Parkinson’s Corporation (“Punch 4 Parkinson’s,” “P4P,” “we,” “us,” or “our”).

By opting in to receive text messages from Punch 4 Parkinson’s, you agree to these Mobile Terms, our Terms of Service, and our Privacy Policy.

1. Program Description

Punch 4 Parkinson’s may send recurring SMS and/or MMS text messages to users who opt in to receive text messages from us.

Messages may include promotional messages, personalized marketing messages, donation updates, giveaway updates, membership updates, subscription updates, event updates, cart reminders, account notices, transaction-related messages, customer service messages, and other communications from or on behalf of Punch 4 Parkinson’s.

2. Consent to Receive Text Messages

By providing your mobile number and opting in to receive text messages, you agree to receive recurring automated promotional and personalized marketing text messages from or on behalf of Punch 4 Parkinson’s at the mobile number provided.

Text messages may be sent using an automatic telephone dialing system, automated technology, or other messaging technology.

Consent to receive marketing text messages is not a condition of purchase, donation, membership, subscription, or participation in any giveaway or promotion.

3. Message Frequency

Message frequency varies.

The number of messages you receive may depend on your activity, purchases, donations, memberships, subscriptions, giveaway participation, account activity, abandoned cart activity, communication preferences, and other interactions with Punch 4 Parkinson’s.

After you reply STOP, we may send you a one-time confirmation message confirming that you have been unsubscribed. After that, you should no longer receive marketing text messages from us unless you opt in again.

7. Transactional and Administrative Messages

If you opt out of marketing text messages, we will honor your request as required by applicable law.

You may still receive non-promotional transactional or administrative text messages where permitted by law, such as purchase confirmations, donation receipts, membership billing notices, subscription notices, account updates, security notices, customer service responses, legal notices, or other messages related to an existing transaction or relationship.

8. Mobile Carrier Disclaimer

Mobile carriers are not liable for delayed or undelivered messages.

Text messaging may not be available on all mobile carriers, devices, or locations. Delivery of text messages is subject to effective transmission from your mobile carrier and network operator.

9. Supported Carriers

Our text messaging program may be supported by major U.S. mobile carriers and other participating carriers. Carrier participation may vary and is subject to change without notice.

10. Changes to Your Mobile Number

If you change, transfer, deactivate, or stop using the mobile number you provided to us, you agree to opt out of our text messaging program before making that change or notify us promptly.

You agree to indemnify and hold Punch 4 Parkinson’s harmless from any claims, costs, expenses, liabilities, or damages resulting from your failure to notify us of a change in your mobile number, including claims brought under the Telephone Consumer Protection Act or similar laws.

11. Privacy

We respect your privacy. Our collection, use, disclosure, and protection of personal information is described in our Privacy Policy.

12. Third-Party Service Providers

We may use third-party service providers, including Klaviyo and other messaging, marketing, ecommerce, analytics, customer support, and technology providers, to operate and manage our text messaging program.

These providers may help us send messages, manage consent, process opt-outs, maintain suppression lists, track message delivery, and support compliance.

13. Dispute Resolution, Arbitration, and Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Mobile Terms, our text messaging program, SMS messages, MMS messages, opt-ins, opt-outs, consent, revocation of consent, marketing communications, transactional communications, privacy practices, data practices, purchases, donations, memberships, subscriptions, giveaways, promotions, or your relationship with Punch 4 Parkinson’s is subject to the dispute resolution, binding arbitration, class action waiver, jury trial waiver, governing law, and related provisions in our Terms of Service.

By agreeing to these Mobile Terms, you agree that covered disputes must be resolved through binding individual arbitration, and not as part of a class action, collective action, consolidated action, private attorney general action, or representative action, except as stated in our Terms of Service.

14. Changes to These Mobile Terms

We may update these Mobile Terms from time to time. When we update these Mobile Terms, we will revise the effective date above.

Your continued participation in our text messaging program after updated Mobile Terms are posted means you accept the updated Mobile Terms.
